Summary

This bill amends the Right to Farm Act to protect agricultural operations or facilities from nuisance claims by providing that no cause of action based upon nuisance may be brought by a person whose claim arose following the purchase, lease or rental of property proximate to a previously established agricultural operation or agricultural facility, except when such previously established agricultural operation or agricultural facility has substantially changed in the nature and scope of its operations.

 

On February 2 the Senate Conservation Committee amended SB 72 to change “purchase, lease or rental” to ” purchase, lease, rental or occupancy.”

 

A possible concern regarding this bill might be that it appears to allow an agricultural operation or facility to inoculate itself against nuisance claims by purchasing, leasing, renting or occupying additional property.
